1 Acceptance of Terms

Welcome to Shram Sarthi (श्रम सारथी), a digital platform that connects customers with verified labour workers (Majdoor), skilled artisans (Karigar), contractors (Thekedar), transport drivers, and agricultural/construction machinery operators across India.

By downloading, installing, or using the Shram Sarthi mobile application or website (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.

These Terms constitute a legally binding agreement between you ("User") and Shram Sarthi Technology Pvt. Ltd. ("Company", "we", "us", or "our").

2 Definitions

Customer: Any individual or business that uses the Platform to book services.
Service Provider / Worker: Any Majdoor, Karigar, Thekedar, Driver, or Machine Operator who registers on the Platform to offer services.
Agent: An authorized representative of Shram Sarthi who assists in onboarding or managing Service Providers in a region.
Booking: A confirmed service request made by a Customer to a Service Provider through the Platform.
Platform Fee / Commission: A percentage or fixed fee charged by Shram Sarthi for facilitating a successful Booking.
Wallet: The in-app digital wallet used for Platform payments, refunds, and rewards.

3 Eligibility & Registration

You must be at least 18 years of age to use the Platform.
You must provide a valid Indian mobile number for OTP-based verification.
Service Providers must complete the onboarding process, which includes identity verification (Aadhaar/PAN), skill verification, and document submission.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate, current, and complete information during registration and to update it as necessary.
Shram Sarthi reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4 Services Offered on the Platform

The Platform facilitates bookings across the following service categories:

Majdoor (मजदूर): General Labour, Construction, Agriculture, Loading/Unloading, Digging, Cleaning
Karigar (कारीगर): Plumber, Electrician, Painter, Carpenter, Mason, Welder, AC Mechanic, Tile Work
Thekedar (ठेकेदार): Building, Road, Labour, and Painting Contractors
Krishi Yantra (कृषि यंत्र): Tractor, Harvester, Rotavator, Thresher, Pump Set, Sprayer
Nirman Machine (निर्माण मशीनें): JCB/Excavator, Concrete Mixer, Crane, Roller
Taxi (टैक्सी): Auto Rickshaw, Car, Bike Taxi, E-Rickshaw
Transport (ट्रांसपोर्ट): Mini Truck, Truck, Tempo, Pickup

Shram Sarthi acts as a marketplace/aggregator only. We are not a party to the actual service contract between Customer and Service Provider. The quality, safety, and completion of services are the responsibility of the respective Service Provider.

5 Bookings, Pricing & Payments

Customers may browse available providers, negotiate rates through in-app chat, and confirm bookings.
Prices are agreed upon between the Customer and Service Provider. Shram Sarthi may display suggested rates but does not fix prices for most categories.
A Platform Fee (commission) may be applied on each confirmed booking. This fee is non-refundable.
Payments can be made through the in-app Wallet, UPI, or other supported payment methods.
Shram Sarthi reserves the right to modify its commission structure with prior notice.
All prices are in Indian Rupees (INR) and inclusive of applicable GST unless stated otherwise.

6 User Obligations

As a user of the Platform, you agree not to:

Post false, misleading, or fraudulent information.
Harass, threaten, or harm other users, Service Providers, or Shram Sarthi staff.
Use the Platform for any illegal purpose or in violation of applicable laws.
Attempt to circumvent the Platform by contacting Service Providers outside the app to avoid Platform Fees after an initial introduction through Shram Sarthi.
Reverse-engineer, decompile, or tamper with the Platform's software.
Share your account with third parties or create multiple accounts for fraudulent purposes.

7 Service Provider Obligations

Service Providers must maintain valid licences, certifications, and permits required for their trade.
Service Providers must honour confirmed bookings. Repeated cancellations may result in account suspension.
Transport and Taxi drivers must comply with all applicable Motor Vehicles Act regulations and maintain valid Parivahan documents.
Machine operators must ensure their equipment is roadworthy and insured.
Service Providers must treat Customers with respect and professionalism at all times.

8 Cancellations

Customers may cancel bookings before the Service Provider departs for the job location. Cancellation charges may apply as per the Refund Policy.
Service Providers may cancel in genuine emergencies. Repeated cancellations without valid reason will attract penalties.
Shram Sarthi reserves the right to cancel any booking it deems fraudulent or in violation of these Terms.

9 Limitation of Liability

Shram Sarthi is a technology intermediary. To the maximum extent permitted by law:

Shram Sarthi is not liable for any loss, injury, damage, or expense arising from services provided by Service Providers.
Shram Sarthi's total liability to any user shall not exceed the Platform Fee paid by that user in the preceding 30 days.
Shram Sarthi does not guarantee the continuous availability of the Platform and is not responsible for service interruptions.
Shram Sarthi is not responsible for disputes arising directly between Customers and Service Providers.

10 Intellectual Property

All content on the Platform, including the logo, app design, software, text, and graphics, is the exclusive property of Shram Sarthi Technology Pvt. Ltd. and is protected under applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

11 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in [City of Incorporation].

Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation or mediation.

12 Amendments

Shram Sarthi reserves the right to modify these Terms at any time. We will notify users via in-app notification or email of significant changes. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
